Witness for the Truth

May God Reward you and yours, Vivian, for your Courage, Charity and Compassion. I do think Our Lord wants to give US no small Victory. I wish someone of your moral and intellectual integrity had been on the jury ... but I thank God daily (and your Great Uncle canonized by Pope John Paul II -- Saint Mateo Correa Magallanes http://saints.sqpn.com/saintm1v.htm -- do you realize that St Mateo began his Seminary on Jan 12, 1881 -- so it's not only Rush H Limbaugh, III's B-Day ;) or merely my Sentencing date -- there is no accident or mere coincidence in God's Divine Providence) that you were a witness to both arrests in 2009 on Holy Thursday night and on Good Friday at the Altar of Repose, and that you were not afraid to Witness to the Truth during my Trial and defense Nov 17-30, 2010.


Jane Panopoulos wanted to come and join you on the stand after her classes ended at noon for my defense on Wed, Nov 24, 2010 and Jane almost made it. She needed the help of a subpoena being a 3rd grade teacher at St Catherine's in Reseda. Jane could have testified more regarding my work at St Therese and with the LA Archdiocesan Discipleship program and all the Masses and devotions she's attended where we've passed each other -- all over the LA Archdiocese. Jane was the person kneeling behind me that touched my shoulder on that Holy Thursday night in 2009 while we were Adoring Our Lord and praying at the Altar of Repose after the Mass (I did NOT know Jane was there behind me either until she put her hand on my shoulder after the police had ordered those 6 other Adorers, including you at the far left end of the pew, Vivian, out of the pew on either side of me -- none of this did I either see or realize since I had my head down on my arms in the pew and was praying with my eyes closed so I did not even see or hear John and Anne Wrot leaving or the others coming in to kneel next to me until the police were on either side of me and all of you were standing in the aisles wondering what was going on and why the police wanted to talk to me) and Jane was the one who offered to go outside with me and be a witness for me with the police.


Fifty (50) parishioners Adoring Our Lord in front of me on Holy Thursday night and even those 50 behind me praying -- did not see or know what all the whispering was about and were sh-sh-shushing so I stood up after Jane had put her hand on my shoulder from behind and had made her offer, mainly so that all the whispering would not disturb those praying (and "asleep" to what was taking place) any further, and then I asked you, Vivian, to come with Jane and me, as well -- otherwise, I would just have continued praying until midnight and let the police wait until our Pastor returned, or those pointing me out and demanding my arrest did something that would make it clear to the police that they were "disturbing the Peace". David Llewelyn, Esq had counseled me very clearly -- so I knew I was NOT "occupying" ... I was remaining in prayer with the other parishioners (general public) at the times the church was "open to the public" and therefore I was NOT "occupying" OR "trespassing" etc.

 I was clearly protected by Constitutional and CA law (both civil and penal codes) and my arrest(s), all the violence and injury done to me; our church of St Therese; my many friends among the parishioners (which injury continues to this day); intimidation, harassment, etc. was, is and remains prohibited by law with STRICTLY DEFINED penalties, which are current and enforceable.


The DA prosecution and Janosiks et al. know this -- and more, Judge Jared Moses et al. know what this case means to Title 18, which is why the 1st Amendment, Constitution, mention of religion, Church and/or Archdiocesan practice and policy were all barred from Judge Moses' courtroom, and why the DA/Prosecution have done everything they thought they could get away with, to stall, cheat and "win" given the "fact" that they never had a case or "cause" to begin with; but especially to forestall Title 18 fallout and prevent 100s of 1000s of $$$ in penalties "once the criminal charges are dismissed", which penalties must be charged against all those "private persons" involved in my arrests, because these "private persons" excluded (or "expelled") the Church, the owners of church property, and lawful authorities when they initiated and set up false criminal charges against a practicing member of the church Faithful and a law abiding citizen, and forced Church matters outside of the Church's venue and Tribunals, and into the venue of State criminal prosecution against members of the Church (including but not limited to myself, the Pastor of St Therese, the local auxiliary Bishop, and the Archbishop of Los Angeles).


But no, for the length of 639 days and counting these "private persons" remain "at large" to bully (and worse) the entire parish (including pastor(s), priests, etc) with impunity... since parishioners at St Therese remain paralyzed with terror, confusion, inaction and/or ignorance of this matter.

"Be Not Afraid" ... fails to move those who choose to hide in all the confusion ---- so the liars thrive and and continue to sink their tentacles deeper -- and the Church suffers.
Vivian -- these criminals saw you at the Trial.

IF you begin to notice ANY intimidation, harassment, threats, any change in policy or attitude toward you from anyone at St Therese ... if at any time, YOU enter or seek enter to St Therese church for Mass or the Sacraments and your entry is barred or obstructed and/or you are intimidated (people watching you or talking about you behind your back -- all sins, of course, but the hellbent have their own agenda) if you feel threatened, harassed -- BE SURE YOU HAVE A WITNESS (or ask someone to witness) -- do what I did and ask someone (I asked Victoria Sandoval who was working at the Pro Life table near my voter registration table on the church steps/patio and who works in the DA's office to be my witness on Oct 19, 2008 ) to witness for you in the event that anyone (ushers, etc.) begins to confront or trouble you.

The same if any of the priests become concerned for your safety and try to suggest that you: "stay away" ... this activity is AGAINST THE LAWS of our State and Country -- (it is also against Church Law and, clearly, God's Law). It is also CRIMINAL activity. YOU can prosecute all who harass, threaten, intimidate or bar or obstruct your entry to a "place of religious worship" and the penalties start at $5,000 for each and every person the first time. The penalty jumps to $50,000 for the 2nd time each of those same "private persons" harasses you, and so on.

The Pastor and I were working within the Church and with the Church's canon laws, lawyers and tribunals. I did NOT initiate pressing civil/criminal charges against John Janosik in Oct 2008 when he barred and obstructed my entry at the main church entrance on Sunday, Oct 19, 2008 near the front steps where I was registering voters (where the Pastor, Fr Jan Lundberg, OCD, had asked me to station my voter registration table for neighbors and parishioners and those attending the Parish Family/Alhambra Festival Carnival and display the Protect Marriage/Prop 8 signs and information) just before the start of the 1PM Extraordinary Form Mass, when John Janosik threatened to call the police. Olivia and Erine and others also witnessed this attempt to bar my entry in ways that helps highlight the malice and injury intended for me.


Instead of pressing charges in state and county courts, I had asked Canon Lawyers to review a stack of false and defamatory letters I had received from STC ministry coordinators between August 2008 and February 2009 that finally noted in writing a few of the false allegations and other character assassinations whispered in the dark in the shadows by the backstabbing "unholy huddle". The Church has Her own Tribunals to deal with unlawful or damaging activity among its members.


Fr Jan and I agreed I would continue attending the 1PM Sunday Mass in the Children's Crying Room (which I entered from the Sacristy that Sunday, October 19, 2008 to avoid John Janosik's attempt to provoke an incident with the police, while the Pastor, Fr Jan Lundberg was away from the church for a few hours for medical therapy after his knee operation). I did continue attending Mass in the Children's Room next to the Sanctuary each week from Sunday, October 19, 2008 through Sunday, March 1, 2009.


But no -- "private persons" -- self appointed "agents" -- of the State can simply take matters OUT of the Pastor's hands, "delegated down" authority from the "owner" of the church into their own hands, and use the Criminal Informant System to order the police to enter our churches, chain up and arrest our parishioners and "expel" them from churches and synagogues and other places of religious worship as revenge against any Faithful Citizen (Hierarchy and Laity) not in lock step with their political and personal agenda. "They will put you out of ("expel" you from) the synagogues and churches: yes, the hour comes, that whosoever kills you, will think that he does a service to God." (John 16:2)


Do you know that if merely 2 of the 50 -- of the 100s -- of Faithful who have ALREADY been harassed, intimidated, threatened, barred from Apostolates and Ministries at St Therese, etc. arrested, discouraged from attending Masses at St Therese church (yes, there are others, including parents and youth) if any one or all of you pressed charges under Title 18, even before my Appeal is won ... you could put a START to THE END of this type of political and personal attack from inside our churches and synagogues across the United States ? Do NOT wait until "private persons" aka "agents" call the police to have you "expelled" from your church on false criminal charges. Even one -- is way over the line in the USA. Remember, the Los Angeles Archdiocesan attorney was BARRED by the Judge from giving testimony in my defense at the LA Superior Courthouse in Alhambra on November 24, 2010.


You, Vivian, are protected by law and the law prohibits most of what has been going on at St Therese parish since my arrival on October 15, 2007, and also long before. The same law that takes our Constitutionally guaranteed 1st Amendment protection to "enter or seek to enter a place of religious worship" and prohibits threats, intimidation, violence, harassment, barred or obstructed entry ALSO is applied (that is our CONSTITUTIONALLY GUARANTEED protection to enter a place of religious worship is extended by law and now ALSO includes those "persons entering or seeking to enter a reproductive health facility".


If our entry, that is, if "persons entering or seeking to enter a place of religious worship" are not protected and that protection is not enforced, then clearly the extension of the law for "any person entering or seeking to enter a reproductive health facility" is also void in the eyes of the law. Judge Jared Moses has opened the floodgates of Heaven and Hell with his arbitrary and lawless "rulings".


Giovanna Setiady is the most thoroughly trusted person by our Pastor, Fr Jan Lundberg, at St Therese -- Giovanna and I both went and looked at the Tabernacle Veil in the Guadalupe/ Sanctuary chapel on Friday morning after Mass on January 16, 2009 (only 3 days after Mrs Cailan interrupted my conversation with Fr Jan in the hallway at the top of the stairs outside the Guadalupe/Sanctuary chapel on Tuesday evening, January 13 and grabbed the Tabernacle Veil out of my hands, which I released immediately (so it would not tear) in Fr Jan's presence -- Fr Jan and I just looked at each other, shrugged and dropped the matter until Friday morning, when Giovanna and I were free to discuss the matter with Fr Jan or together as we eventually did). This Veil was in the same chapel where Linda and I had worked for weeks and completed all the cleaning from the smoke damage (that had not been done by anyone since the Sylmar Fires of 2008) -- I had washed all the sheer curtains and windows and Linda was trying to buy new drapes -- these are the clean windows and sheers the "private persons" used on Good Friday to point out where I was sitting and praying -- between the Setiady and the Urquidi families.


When Giovanna and I examined the Tabernacle Veil on Friday, Jan 16 (we asked Fr Jan to come and look at the Tabernacle Veil with us but the Pastor was busy with some carpenters) the Tabernacle Veil was NOT "torn" that we could see (if Mrs Cailan tore the Veil accidentally either with her long nails or trying to put the Veil back on the Tabernacle because she is short, or if there was a pre-existing small tear, we did not see it -- the Veil looked fine) and Giovanna and I both decided the Veil did not need washing any more -- it looked clean and I had noticed this on Jan 13 before Mrs Cailan grabbed the Veil out of my hands -- Giovanna thought she remembered that Rebecca had offered to wash the Veil quickly, sometime after I had been given the task just before Christmas but too late for me to actually wash the Veil in time for the Christmas Masses (I had simply been told to wash the Veil when the Tabernacle was empty -- on a weekday after the Christmas, Sunday/Weekend and Holy Day Masses -- so my earliest real opportunity to do so was after Night Prayers on Jan 13, 2009). I suggested to Giovanna -- that early Friday morning on January 16 that we probably needed a new Veil since that Veil had cheap silver sparkle on it that made the Veil LOOK grey and dusty even when clean, and even when additional smoke damage from the Sylmar fires of October 13, 2008 no longer covered the Tabernacle Veil with filth. The smoke ash had remained on that Veil for months until Linda and I noticed it while working on that chapel just before Christmas. A few weeks after our discussion on Jan 16, I noticed a new Veil on that Tabernacle during Evening Prayer. It definitely looked whiter.


We now have testimony under Oath on record that proves the drama of the fictional scripts that Timar et al. concocted for Fr Jan and others in the week(s)/month after Jan 13-16, were all clever lies and master deceits from start to finish. If a tiny tear pre-existed in this Tabernacle Veil, it was enlarged and maximized for dramatic emphasis, or the Veil was torn accidentally (since these "church ladies" are half my height) or deliberately -- by the duo. God Knows and Judgment Day is coming.


I hope, Vivian, that everyone at St Therese who was afraid to witness to the Truth or terrorized or deceived or group-hugged into silence or is hiding under a bushel basket will at least come to my Sentencing on January 12, 2011. "Be not afraid." Hear and see with your own eyes and ears before it is too late for you and yours, and all those who LIVE the Gospel, practice their Faith, protect Marriage and the family, including those Religious who LIVE the Evangelical Counsels -- and who remain Faithful Citizens in these United States of America.

I feel badly about the outcome. We must offer it up.

I wish at least one person would have held out so that your case could have been declared a mistrial.

This is what happened when I last served as a juror. Two of us held out for not guilty while the other eight allowed themselves to be dominated and persuaded by two overbearing, quick-to-judge personalities; their not following the court's (judge's) instructions resulted in shouting and chaos in the deliberations. I and the other person wrote separate notes to the judge, letting the court know of this juror misconduct. Case was declared a mistrial, we were sent letters of appreciation for our service, and an innocent person was kept from the found guilty. I held out under pressure for I was not going to let those other jurors convicted this person for the prosecution had not proven its case beyond a reasonable doubt.
