I need everyone who can come and be there, to be in the courtroom from 1:30 AM to 4:30 AM (Nov 22, 23, 24 ... we break for Thanksgiving ... Nov 29, Dec 1, Dec 2, Dec 3 etc.). On one or two days we may begin court at 10:30 AM but that will be rare and only after Nov 29.

It is very crucial that you hear with your own ears directly and see with your own eyes directly what occurs in this courtroom and it is even more important to ALL of us that you be in that courtroom PRAYING ... We demonstrated how crucial silent / contemplative prayer IN THE COURTROOM is with Joe Scheidler's USSC case, amazing things take place in a court room, including the US Supreme Court, when good souls are inside the court to witness the proceedings, while at the same time, in silent (obviously non-disruptive) prayer.

 

There will be a ton of character assassination, defamation etc but now, it will be "on record" "under oath" and "public testimony". God Willing the law will cut through the smoke and mirrors and all the distractions; as St Thomas More pointed out -- we may still have a legal tree or even a bush or two to shield US !

KRISTIN KAZYAK, who has been working as a catechist in California, was arrested while inside St. Therese Church in Alhambra, while praying before the Altar of Repose after Holy Thursday Mass (4/9/09). She was arrested again on Good Friday (4/10/09) – while praying before the Altar of Repose – after the Eucharistic Liturgy and the Divine Mercy Novena. Her trial is reset for Nov 17*- Dec 3 ... (*Feast of St Elizabeth of Hungary)

This politically-motivated arrest has to do with Kristin's orthodoxy, her conservatism, her spunk, and the fact that she was 2008-2009 Co-Chair of the Alhambra CCG (Catholics for the Common Good) Prop 8/ProtectMarriage coalition (the CA ballot initiative passed in November 2008 defining marriage as an act only between a man and a woman; the initiative won a
challenge in the California Supreme Court in 2008 and is currently challenged in San Francisco's Federal District Court).

Kristin has been charged with criminal trespass. However attorney David Llewellyn, Jr. of Citrus Heights, California, argues that federal law protects the right of people to attend places of religious worship without interference or intimidation by force or threat of force as an aspect of their First Amendment right to free exercise of religion.

Also, Llewellyn says, attending a Mass that is open to the general public and participating in the manner that all the other attendees participate appears to be constitutionally-protected
activity under the California Constitution. Since her demeanor and behavior at Mass was in no way disruptive (she had to be pointed out to the guards (police) by a modern-day Judas – ironically this was on Holy Thursday), Llewellyn sees no legal justification for an arrest.

Llewellyn and Sam Casey, Esq., lined up a prominent local criminal attorney, Douglas Kirk on April 9, 2009. On March 19, 2010 just prior to a trial date of March 24, Casey and Kirk referred Kristin to Jeannine Stewart, Esq. to take the 1st two (2) cases to trial turning over the $15,000 retainer raised Feb - Mar 2010 to take the 2 cases to a Jury Trial. Prosecution "withdrew" their motion for joinder to consolidate the 3 cases/arrests on Jan 21, 2010 (and the rotating [i.e., no permanent assignment] Public Defender(s) "trailed" with the 3rd case/arrest since the #3 case would "go away" with the dismissal of the 1st 2. Jeannine Stewart is a Criminal, Constitutional and Civil attorney. Defense strategy is to get the trespass charge dismissed and prosecute Constitutional, Civil and Penal Code violations for penalties, damages and legal fees.

Stewart announced "ready" for trial on May 3, July 6, and Aug 23, and again Oct 4 & Nov 10. The prosecution stalled -- "not ready". On Aug 30 a new judge took the cases, forced a "consolidation" of the 1st 2 cases/arrests (already force-consolidated by police/DA Steve Cooley-Prosecution/judge on Apr 13, 2009) WITH case # 3 -- the 2009 Oct 13 arrest so that ONLY one (1) attorney could represent Kristin for ALL 3 cases, and the 3rd case could not be dismissed without going to trial after the 1st 2 non-cases were dismissed! Stewart was retained ($15,000) to take only the first 2 cases to trial, so Stewart was essentially forced to "withdraw" and give her trial preparations to the PD/Public Defender, or Kazyak retained Stewart at $7,500 to handle the 3rd case also.

Kristin has been subject to harassment, intimidation, and now 3 arrests for her beliefs. After being escorted out of the church by two police officers, she was handcuffed and taken to the Alhambra City and LA County jails where she spent seven (7) days, barred from attending Easter Sunday and Easter Week Masses. If you know Kristin, you know that she cannot be easily intimidated. But what about the rest of us "domestic terrorists" (defined as anyone who is pro-life, pro-marriage, or owns a gun or has served in the military)? If Kristin loses this case, it paves the way for the leftists who oppose our beliefs to intimidate us – and have you and me arrested – maybe even in church as well!

Kristin was again arrested on Oct 13, 2009 a block from St Therese Church where she had parked for 6 months while waiting to join the Fatima Eucharistic Processions each 13th of the month on public sidewalk. She was praying the Rosary inside her locked car on Alhambra Rd, because she could not join her parish or a disabled Knight of Columbus for Mass and Benediction inside the church without violating bail bond and an illicit CPO.

A bench warrant issued without contacting Kristin or her attorney charged Kristin had violated a CPO/Criminal Protection Order (issued during an April 13 arraignment by judge and the prosecutors AFTER her arrests on Holy Thursday and Good Friday April 9 &10 -- Kristin was denied all calls April 10-13 from the jail and told her attorney would NOT be present in court on April 13) by receiving Holy Communion in July from her Pastor at the Carmelite Cloister Chapel of St Teresa almost a mile from her parish church and in June during Mass on Corpus Christi at the parish picnic in Garfield Park (several miles away) and during Eucharistic Fatima Processions on public sidewalks!

Oct 13, 2009 Kristin was placed in Maximum Security Isolation in prison for 12 days (she was finally released on bail bond by donors at 3AM on Oct 24, 2009). Kristin was ordered to wear the "orange" terrorist prison uniform from 2AM to 3AM prior to her release on bail and was also "straight jacket-chained" and caged alone (violent/terrorist/insanity risk) during transports to and from court hearings during those 12 days -- all 19 days in prison without benefit of Trial or Sentence, $45,000 in bail bond, without access to her attorney (save by persistence and exceptional, in fact, miraculous, intervention) !!!

Also please pray for Kristin – and our country – as we face the culture of death and the haters of the Truth, and persecution for our beliefs.

NB: This latest attack strategy against Faithful Citizenship works to isolate the individual from churches and groups designed to support and defend our 1st Amendment,
Constitutional, civil, penal and other legal protections and privileges. Our opposition prefers to avoid court litigation and substantial loses in time and money with organizations like the ADF (Alliance Defense Fund) and other well-funded 1st Amendment or Constitutional attorney groups that have a high success rate in court.

Instead, efforts to target, defame and criminalize Faithful Citizens through "private persons" who use the (protected) Criminal Informant/Justice System (and your tax $$$) to initiate arrests, allow the Enemy to ensure the victim will not have access to ADF or other
publicly funded civil attorneys, or a speedy trial, etc.

This abuse of our Criminal Justice/Informant System consumes your tax dollars (defers resources and attention from actual criminals and terrorists) to employ secular and state courts for attacks on religious persons and authorities while at the same time using the state to "excommunicate" (i.e., lock out/bar from their churches) Faithful Citizens, whom the Church (churches, synagogues and their own religious courts and authorities) will not "excommunicate" !

IF a clear precedent is set by WINNING these 3 cases and fining those "private persons" who did, in fact, violate our laws and constitutions, we can prevent/limit further anarchy of this type in our churches and courts by enforcing laws that already protect against and prohibit such mischief against "private property", a "place of religious worship", Faithful Citizenship, personal
reputation, and our state and federal Constitutions. Many in our military have died or will / suffer injury defending our Constitutional freedoms here and abroad -- we too can contribute our best to hold the line and preserve our Freedoms wherever God has put us in His Providence.

(Kristin) I missed the meeting on Easter Monday [April 13] because I was in chains in prison. I spent six days at the gates of Hell, and so I catechized there and helped some amazing women. The point is that this is Christ’s work. It’s not the place or the way I would have thought, or chosen, to do Christ's work. I wanted very much, expected, and asked Our Lord to make
it possible, to be here with you. At the same time, I reassured Him I was willing, content and happy to do whatever He preferred -- His Will His Way. So, He blessed me with another sort of Discipleship that Easter Monday night -- one I could not possibly have chosen or ever thought
myself worthy or capable of -- but it clearly wasn't me -- it was entirely Him -- His doing -- His Will. Ultimately, that is what this exercise is all about. We were all still together in Christ.

Client Attorney Privilege ... and communication that helps win this one for Faithful Citizens, the US Constitution, the Penal Code and Civil Law !

· February 2009 : I am being warned that since the pastor did not cave to pressure to bar me from Mass, the Sacraments and devotions last year at St Therese church; that those same individuals are now threatening the Pastor with "going to the Bishop" to get a restraining order to bar me from Mass, the Sacraments and devotions at St Therese church ... I contact canon lawyers to see what can be done to end the ongoing character assassination

· Mar 3, 2009 5:30PM I receive a list of [false] allegations for the first time in writing in a private correspondence hand delivered by the author that was not copied to (or typed by) anyone else; the author is a direct witness to the falsity/deceit of most of these allegations

· I had over 5 weeks of legal consultation (between March 3 and April 9, 2009 during which I did not return to STC for my daily Masses) while a Constitutional attorney in contact with Roman Catholic Church Tribunal and Canon lawyers, etc researched and wrote a memo and letter highlighting my Constitutional and legal protections and the prohibitions that protect my/our ... entry to a Place of Religious Worship, etc.

· I whispered to the APD (Alhambra PD) police when they came into my pew on either side of me in the church to arrest me on Holy Thursday night that I would continue praying with the rest of those in Adoration at the Altar of Repose (put my head down and continued praying as I had been); when they persisted I whispered that the Pastor was not there; they did not know the people calling them, or how their pattern of intimidation involved the police in unnecessary calls and wasted time, and that I was protected by law

· I was not permitted to call or contact my attorney until after I was arraigned (and I was told "your attorney will NOT be at your trial on [Easter] Monday" by Watch Commander Rodriguez) between my 5PM April 10 arrest on Good Friday and until the officer in the court jail hold allowed me to use his desk phone [Douglas Kirk's office does not accept collect calls] at 5PM on April 13 (after Judge Ruiz' clerk found and gave me Doug Kirk's phone number as I left the court and after the Apr 13 arraignment at 4:30 PM and a CPO was issued [even tho I was clearly the one person who really needed the protection of the law from these "private persons" and trusted that I had it] to "protect" the "private persons" who used the CIS to call police and arrest me, based on nothing -- and nothing more than hearsay from DA prosecutors and 2 arrests made by "private persons" on Holy Thursday and Good Friday; and their demand that the Pastor be included in this "protection" even tho the Pastor was absent during the arrests; could have no legal or canonical involvement in excommunicating me; and none of those listed had "cause" to need "protection" as I did not have any social contact with these "private persons" in or out of the church)

· I had gone to the APD police station on the morning of April 9 to show the Police Chief (but was intercepted by Watch Commander Rodriguez) David Llewellyn, Esq's letter of April 1, 2009 to Fr Jan Lundberg, OCD and to remind the police of the pattern of harassment, intimidation, injury to church property that I'd already reported for the record over the last year, including all the incidents dismissed in my favor or simply reported (i.e., the Protect Marriage sign slashings, mutilations, and thefts in Oct 2008; some months later, I rec'd an email form APD police records asking who the "owner" of the church was, which seemed strange at the time -- God is the "owner" of His House; we who are the "Living Stones" and who practice our Faith and support the Church are the "owners" and builders both spiritually and materially, and the Archdiocese holds a property deed donated and specified by a devout donor -- the Carmelites have Vows of Poverty and reside at the invitation of the Bishop and my CA Driver's License still shows 510 N El Molino Street as my original mailing address and "residence" since I received mail at the Church Office from the time Fr Jan Lundberg moved me from Costa Mesa to Alhambra and into the old Convent on Oct 15, 2007 -- so the matter of "ownership" of the church when I was reporting vandalism and property loss seemed an odd, irrelevant and a curious question in late Dec 2008/early Jan/Feb 2009 coming from the police records archive -- not that the gang members bused in from East LA into our Parish and neighborhood or the "private persons" doing the busing were ever tracked down -- but maybe someone knows where a fellow named "Mucous" is these days and could subpoena "Mucous" as a defense witness -- Jim DeTardo and I had a wonderful chat with these 9-10-12 year-old gang members on Oct 19, 2008 while I was registering voters for the election deadline on the STC church steps during our Parish/Alhambra Family Festival).

· Sep 13 -- I went to the APD station to ask for the badge number and name of a police officer that tried to intimidate and harass me while I was praying the Rosary in my locked, parked car on a public street at c. 8:50 PM while waiting for a friend to leave the last Benediction inside St Therese church; other witnesses saw this officer outside his patrol car watching the Eucharistic Procession through the neighborhood sidewalks of Alhambra; Watch Commander Rodriguez gives me the name and badge number on the station phone and then comes out to threaten me with 3 weeks in prison for violating a "restraining order" for St Therese church which, I reminded WC Rodriguez, "never existed" (prior to my arrests on Apr 9 & 10). A week later Rodriguez initiates "conversations" and issues a bench warrant and I am arrest on Oct 13 praying the Rosary in my locked car at the same location where I have parked since July 13 c. 8:22PM because it was pouring rain and the "Fatima Eucharistic Procession/Benedictions" remained inside St Therese church that one night in the 6 months between May 13 and Oct 13.

· I was not permitted to call my attorney after my arrest on Oct 13, 2009. The DA Prosecutors/Judge Ruiz had contacted Kirk and told me in court Kirk was not taking this case ! Kirk had no contact with me until 5:15 PM Oct 14 after the court arraignment ended, when I was allowed to call Kirk from the court jail hold desk once again. The officers cut off our conversation after a few minutes and Kirk had to call them back and tell them that he had the right by law to talk to me, etc. We were given 15 minutes. Since there was no "restraining order" for the first 2 arrests; this was clearly an attempt to eliminate the first 2 cases and my private attorney, and invent another case with an illicit CPO (Criminal Protection Order) against A PRACTICING CATHOLIC and LAW ABIDING CITIZEN (and against a PASTOR/Priest of the Church) with no prior criminal history or arrests despite the fact that I have been involved in Pro Life prayer and counseling at abortuaries since June 6, 1970 and whose presence with Christ at Mass and in/during the reception of Christ in the Blessed Sacrament or while in Procession with Christ in the Blessed Sacrament is being barred and made CRIMINAL because "private persons" use the Criminal Informan System to further their own political and/or personal agendas.

· I was placed in Maximum Security Isolation; straight jacket chained and isolated for court transports for 12 days of the 19 days served without trial or sentence; prison guards forgot I was in the cell and forgot to feed me; muttered that I had been cleared for General Population so what was I doing there(?); and finally during my last hour prior to my release on $45,000 bail ($10,000 for arrests 1 & 2 and $35,000 for arrest 3) ordered me to wear the Orange terrorist prison uniform (my intake uniform had not been changed for 12 days) and guards repeated questions during that last hour : what color uniform was I wearing; why I was in that section of the prison for the criminally insane and suicidal; and why I was wearing Orange. [On the last, I simply replied I did not know because I had not been tried or sentenced and I expected release on bail shortly. I was escorted away and released about 15 minutes later.].
